When buying a new build property, it is important that you choose an experienced lawyer who is independent from other parties in the transaction.
 
You will need a lawyer to:
- Ensure the builder grants a bank guarantee for each stage of your payment, in the event that the property is not completed
- Check the builder has the correct Town Hall Building Licence: 'La Licencia de Obras'
- Check for a detailed building description of the materials used, known as 'Memoria de Calidades'
- Collect the property plans (Plano de le Vivienda y Plano de la Urbanizacion)
- Obtain the new build deeds and 'La Escritura de Obra nueva y Division Horizontal' architectural certificate
- Ensure the 'Certificado de final de Obra'/final completion certificates are provided for your property
- Submit the habitation certificate: 'Declaracion Responsable de Primera Occupation'
- Ensure the building company has a 10 year insurance guarantee for structural defects, known as 'Seguro Decenal'
- Obtain 'Boletin de Agua y de Luz' - proof of water and lights installation
- Arrange property registration in the SUMA office
 
After this, the builder is able to attend the notary and sign over the deeds as completed 'Final de Obra'. You can then sign the deeds to your new Spanish property.
